1. Who we are

Pomarium LLC (“Pomarium”, “we”) provides orchard analytics software, including the Pomarium GAIA platform and the Pomarium AGER phone app. These terms cover your use of both. By creating an account or subscribing, you agree to them.

2. What the service does

Our software reads publicly available satellite imagery and weather data for field boundaries you provide, and presents measurements, models and suggestions derived from them.

It is decision support, not agronomic advice. Satellite and weather data carry error, models are approximations, and cloud cover can hide a field for weeks. Every irrigation, spray, harvest or financial decision remains yours, and should be confirmed in the field. We do not accept liability for crop outcomes.

3. Accounts

You are responsible for your login and for activity under it. GAIA accounts are created by us for a named company; AGER accounts may be created by you. Tell us promptly if you believe an account has been used without your permission.

4. Subscriptions, payment and renewal

• AGER Saved includes up to 20 saved fields. It is charged at the price shown in the App Store or Google Play at the time of purchase, which varies by country, is displayed in your local currency, and includes local tax where applicable. In the United States it is currently 6.99 USD per month or 69.99 USD per year. The store always shows the exact amount before you confirm.
• AGER Saved is purchased through the Apple App Store or Google Play. Apple or Google is the seller for that transaction, collects payment and any tax due in your country, and their terms apply to the payment itself. Pomarium never sees or stores your card details.
• Subscriptions renew automatically until cancelled. Cancel any time in your App Store or Google Play account settings; access continues to the end of the period you have already paid for.
• Refunds for store purchases are handled by Apple or Google under their own policies. If something has gone wrong, write to us as well and we will help.
• GAIA is sold per block under a separate agreement with your company.

5. Your field boundaries and data

Field outlines you draw or upload remain yours. We store them to provide the service, and we do not sell them. AGER stores the outline only — imagery and weather are fetched fresh each time and not accumulated against your account.

We may use aggregated, de-identified information (for example, how many fields are read in a week) to operate and improve the service. That never identifies you, your company or the location of your blocks.

6. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. It depends on third parties — satellite data providers, weather services and hosting — whose outages we do not control. Planned work is announced where we reasonably can.

7. Acceptable use

Do not attempt to break, overload or gain unauthorised access to the service, resell it without our written agreement, or use it unlawfully. Public tools such as Try your block carry usage limits so they stay available to everyone.

8. Ending an account

You may stop using the service at any time. We may suspend an account that breaches these terms or does not pay, and will normally tell you first. On closure we delete your saved outlines within a reasonable period; ask us if you want them sooner or exported.

9. Liability

To the extent the law allows, our total liability for any claim relating to the service is limited to what you paid us in the twelve months before the claim. We are not liable for lost profit, lost crop or other indirect loss. Nothing here limits liability that cannot lawfully be limited.

10. Changes

We may update these terms. Material changes will be notified by email to subscribers before they take effect, and the date at the top of this page will change.

11. Governing law

These terms are governed by the laws of the State of California, United States, and the courts there have jurisdiction — except where the law of your own country gives you rights that cannot be set aside by agreement.
